Terms of use

Agreement

These terms are between you and siltra GmbH, Bodenacherstrasse 58, 8121 Benglen, Schweiz, the company that operates Nestivi. They apply to people looking for a home and to people who publish one. Using Nestivi means you accept them. If you do not accept them, do not create an account, publish a listing, or send an inquiry. You can still read the public pages. The date under the title is the version.

The service

Nestivi lists homes in Switzerland. You can search published listings without an account. An account is required to publish, to save a home, to save a search, and to use the inbox.

Nestivi is a marketplace and classifieds tool. It shows listings that users publish and passes an inquiry to the listing owner. Nestivi is not a real-estate broker, not an agent, and not a party to a lease or a purchase, unless a later written notice says that a named service is brokerage. Nestivi does not negotiate the contract, draft it, or check that a listing is lawful, still available, or correctly priced.

Guides on the blog are general information. They are not legal, tax, or financial advice.

No payments

In this beta, search and publishing are free. Nestivi does not take a payment, hold a deposit, or offer checkout. Rent, a purchase price, or any fee is agreed outside Nestivi, between the people involved. Do not send card numbers or payment instructions in an inquiry.

Seekers

• Send an inquiry only if you are genuinely interested in that home.
• Use your own name and an email you actually read. The listing owner will see what you submit.
• Do not scrape, crawl, or bulk-download listings, photos, or contact details, and do not bypass technical limits.
• Saved-search email is optional. Turn it off on the saved-searches page when you do not want it.
• A listing can be wrong, incomplete, or already gone. Check the facts with the person who published it before you rely on them.

Landlords and agencies

• Publish only a home you are allowed to offer, in Switzerland.
• Keep the listing accurate: price in CHF, address, rooms, and description. Photos and floor plans must be of that home. Correct or archive the listing when it is no longer true.
• You are responsible for the text and files you upload. That includes copyright, and personal data of other people, such as a tenant who has not agreed to a photo.
• Use inquiry contact details only to answer that inquiry. Do not sell them or use them for unrelated marketing.
• Private notes in the inbox are for you. They are not shown to the seeker. Store only what you are allowed to store.
• Nestivi may remove a listing that is unlawful, misleading, or not a home in Switzerland. During the beta this is a manual effort. It is not a promise that every listing is reviewed before it is public.

Accounts

Keep the sign-in to yourself. You can change your name, phone, and language on the account page. There is no self-serve deletion of an account yet; ask through the privacy contact. Signing out does not delete the account. A seeker account can become a landlord account from the account page. Agency and admin roles are not a switch you can set yourself.

Acceptable use

Do not scrape the site. Do not try to break access controls, read another person’s inbox, or upload malware. Do not publish a listing that is not a home in Switzerland. Do not post unlawful content.

Your content and Nestivi’s

You keep the rights in text and images you upload. You grant the operator a non-exclusive licence to host, display, and back up that content, and to include a short description of a matching home in an alert email, for as long as the listing or the account needs it. You can end this for a listing by archiving or editing it. Copies may remain in backups for a limited time.

The Nestivi name, the layout, and text written by Nestivi, including these pages and the guides, stay with the operator. Map tiles belong to Esri. Their credit stays on the map.

Availability

The beta can change, fail, or be taken offline. A listing can disappear if it is archived or if data is reset during development. Nestivi does not promise a particular uptime, or that an alert email will arrive.

Liability

To the extent Swiss law allows, the operator is not liable for a decision you take from a listing, for a contract you conclude with another user, for lost profit, or for indirect damage. Listings are content from users. Nestivi does not warrant that a home is available, that a price is right, or that a photo is current.

These terms do not limit liability that Swiss law does not allow to be limited, including for unlawful intent or gross negligence, or for death or personal injury where mandatory law forbids a limit.

Swiss law and venue

Swiss law applies. Conflict-of-law rules that would send the dispute to another country’s law are excluded, as is the United Nations Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is the courts at the registered office of siltra GmbH in Benglen, Canton of Zurich, Switzerland. Courts that Swiss law requires, including for consumers where those rules apply, remain available.

Changes and contact

If these terms change, the date under the title changes. Continuing to use an account, publish, or send an inquiry after that date means you accept the update for the beta. If you do not accept it, stop those uses and write to support@siltra.ch.
